Terms of Service

PrankLab.io ("PrankLab", "we", "us") is operated by Stack Max LLC, 30 N Gould St, Ste R, Sheridan, Wyoming 82801, United States. These Terms of Service ("Terms") govern your access to and use of the PrankLab website, the prank generator, and everything we offer through them (together, the "Service").

By creating an account, joining the waitlist, buying credits, or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.

These Terms incorporate our Acceptable Use Policy, Refund & Cancellation Policy, Privacy Policy, Cookie Policy, and Copyright, Likeness & Takedown Policy. Together they form one agreement.

PrankLab is for adults. You must be at least 18 years old to create an account, upload a photo, or buy anything. There is no version of this Service for children, and we do not knowingly allow anyone under 18 to use it.

By using the Service you confirm that you are 18 or older, that the information on your account is accurate, and that you are not barred from using the Service under the laws that apply to you. If we learn that an account belongs to someone under 18, we close it and delete its content.

You are responsible for everything that happens under your account, including keeping your password secure. Tell us at once at hello@pranklab.io if you think someone else has access to it.

PrankLab takes a photo you upload and generates a new photo or short video around it using AI. The result is an invented scene. It is not a photograph of something that happened, not evidence, not journalism, and not a factual record of anything or anyone.

AI generation is not precise. Results vary between runs, faces may be imperfect, text inside an image may be garbled, and a specific template will not always produce what you pictured. We do not promise any particular output, quality, likeness accuracy, or resemblance, and a result you dislike is not by itself a defect. See our Refund & Cancellation Policy for what does count as a failed generation.

Results are not exclusive to you. The same template and a similar photo can produce a similar result for someone else, and we do not guarantee that anything you generate is unique.

This is the most important rule on this page, and the one we enforce hardest.

You may upload a photo of yourself, or a photo of another identifiable person only if that person has agreed to appear in an AI-generated prank. Every time you upload, you confirm to us that:

• you own the photo or otherwise have the right to use it;
• every identifiable person in it is either you, or someone aged 18 or over who has given you permission to use their image for this purpose;
• that permission covers having their likeness altered by AI and the result being shared; and
• using the photo this way does not break any law, contract, or court order that applies to you.

You must never upload a photo of a child, a photo taken without the subject's knowledge in a private setting, or a photo of someone who has told you not to. If someone withdraws their permission, delete the uploads and results that contain them.

If you appear in something generated on PrankLab and you did not agree to it, email legal@pranklab.io and we will review and act. You do not need an account to report this — see our takedown policy.

PrankLab is for harmless jokes between people who know each other. Our Acceptable Use Policy sets out in full what you may not do with the Service. In summary, you must not use PrankLab to harass, bully, threaten, defame, sexualise, defraud, or impersonate anyone, to create fake evidence or fake news presented as real, to depict minors, or to do anything illegal where you are.

Breaking the Acceptable Use Policy is a breach of these Terms and can cost you your account without a refund.

Once you download a result, what happens next is on you. We ask three things of you, and they are conditions of using the Service:

• Tell the person. A prank ends with the reveal. Do not leave someone believing a generated image is real.
• Do not present results as genuine. Never pass a generated photo or video off as a real event, real footage, a real news report, or real evidence — to anyone, including strangers, employers, insurers, courts, or the press.
• Respect the AI labelling. Results include an on-product AI-generated label, and many exports carry a visible watermark. Every export also embeds provenance metadata. Do not strip that metadata. Where a platform or a law requires disclosure when you share, making that disclosure is still your responsibility.

Visible watermarks appear on sensitive template categories, and cannot be removed on those categories. On everyday comedy templates, paid plans may export without a visible watermark; provenance metadata remains. Some countries require AI-generated media to be labelled when published — where that applies to you, labelling it is your responsibility.

Paid plans are sold as credits. A photo prank costs 1 credit and a video prank costs 3 credits. Current prices and plan contents are on the pricing page and are the ones that apply at the moment you buy.

• Prices are in US dollars and exclude any sales tax, VAT or GST, which is added at checkout where it applies.
• Paid plans renew automatically at the end of each billing period at the then-current price, until you cancel. You are authorising that recurring charge when you subscribe.
• Monthly credits are added at the start of each billing period. Unused monthly credits roll over for 30 days and then expire.
• Credits have no cash value, cannot be exchanged for money, and cannot be sold or transferred between accounts.
• A credit is spent when a generation starts. If a generation fails through our fault, we return the credit.
• We may change prices. Existing subscribers get at least 30 days' notice by email before a price change takes effect on their plan, and can cancel before it does.

Payments are processed by Stripe, Inc. We never see or store your full card number. If a payment fails we may retry it and may suspend paid features until it clears. Charges appear on your statement as PRANKLAB (billed by Stack Max LLC).

Cancellation and refunds are covered in full by our Refund & Cancellation Policy, including the statutory 14-day right of withdrawal for consumers in the EU and UK.

You keep all rights you already had in the photos you upload, and as between you and us, you own the results you generate. We do not claim ownership of either.

To actually run the Service, you grant us a limited, worldwide, royalty-free licence to host, store, copy, transmit and process your uploads and results, and to pass them to the infrastructure and AI providers listed in our Privacy Policy — solely to operate, secure and support the Service for you. That licence exists only for as long as we hold the content, and it ends when you delete it.

We do not use your uploads or results to train AI models, and we do not sell them, publish them, or put them in our advertising. If we ever want to feature something you made, we will ask you first and you can say no.

We may access your content when we genuinely need to: to investigate a report of misuse, to comply with a legal obligation, or to fix a fault you have asked us to fix.

The Service itself — the templates, prompts, software, design, text, artwork, and the PrankLab name and logo — belongs to us or our licensors and is protected by copyright and trade mark law. These Terms give you permission to use the Service, not ownership of any part of it.

You must not copy, resell, sublicense or white-label the Service, scrape it, reverse engineer it, work around its usage limits or content filters, run automated tools against it without our written permission, or use it to build a competing product.

Commercial use of the results you generate is permitted only on the Studio plan, and only within the Acceptable Use Policy.

The Service depends on third parties for hosting, storage, AI generation, payments and email. They are named or described by category in our Privacy Policy. Their availability affects ours, and an outage or change at a provider may interrupt or alter the Service.

Links from our site to other sites are for convenience. We do not control them and are not responsible for their content or their privacy practices.

You can stop using PrankLab whenever you like and delete your account from your account settings.

We may suspend or terminate your account, remove content, or refuse service if you break these Terms or the Acceptable Use Policy, if we are required to by law, if your use creates a genuine risk to other people or to the Service, or if we reasonably suspect fraud or payment abuse.

Where it is reasonable and lawful to do so we will warn you first and give you a chance to put it right. For serious breaches — content involving minors, sexual content, threats, fraud, or fake evidence — we act immediately and permanently, and no refund is due. We may also remove reported content while we investigate a report about it.

If you think we got it wrong, email legal@pranklab.io and a person will review the decision. When your account closes, your uploads and results are deleted on the schedule in our Privacy Policy, so download anything you want to keep first.

Except where the law says otherwise, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.

We do not warrant that the Service will be error-free or continuously available, that generated results will meet your expectations, or that any content will be preserved without loss. Keep your own copy of anything that matters to you.

Nothing in these Terms limits rights you have as a consumer that cannot be limited by law. In some countries that includes guarantees we cannot exclude — where that is so, those guarantees apply and this section does not override them.

To the fullest extent permitted by law, neither we nor our suppliers are liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, lost goodwill, or the cost of substitute services, arising from or connected to your use of the Service.

To the fullest extent permitted by law, our total liability to you for all claims in any 12-month period is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or one hundred US dollars (USD 100).

These limits do not apply to liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or to any other liability that cannot lawfully be limited. If you are a consumer in the EU or UK, your statutory rights are unaffected.

You agree to indemnify and hold harmless Stack Max LLC and its officers, employees and suppliers from any claim, demand, loss or expense (including reasonable legal fees) brought by a third party and arising from your uploads, the results you generate, how you shared them, or your breach of these Terms or the Acceptable Use Policy.

In plain terms: if you upload someone's photo without permission, or pass a generated image off as real and someone is harmed by it, that is your liability, not ours.

PrankLab is an evolving product. We may add, change or remove templates and features. If we discontinue a paid feature you rely on, we will give reasonable notice and, where appropriate, a pro-rata refund under the Refund & Cancellation Policy.

We may update these Terms. The date at the top of this page always shows the current version. For changes that materially affect your rights or your money, we give account holders at least 30 days' notice by email before they take effect. Continuing to use the Service after that means you accept the new Terms; if you do not, cancel before they take effect.

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. The courts of Sheridan County, Wyoming have exclusive jurisdiction over any dispute, and you and we both consent to that jurisdiction.

If you are a consumer resident in the EU or UK, this does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may also bring proceedings in the courts of that country. EU consumers can use the European Commission's online dispute resolution platform at https://ec.europa.eu/consumers/odr.

Before starting formal proceedings, please email legal@pranklab.io and give us 30 days to resolve it. Most things are fixable with an email.

If any part of these Terms is held unenforceable, the rest stays in force. Our not enforcing a term on one occasion is not a waiver of it. You may not assign these Terms without our consent; we may assign them to a successor in connection with a merger or sale of the business.
